By accessing or using WhizPass, you agree to be bound by these Terms in full. If you do not agree, you must not use this platform. WhizPass provides no guarantees of any kind. Use of this platform is entirely at your own risk.

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and WhizPass ("we", "us", "our", "the Platform"). By registering an account, accessing, browsing, or otherwise using WhizPass in any manner, you unconditionally accept and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

We reserve the right to amend these Terms at any time without prior notice. Your continued use of the Platform following any amendment constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

2. Nature of the Platform

WhizPass is an independent, third-party study and practice platform. We provide an environment in which users may practise exam-style questions, track their study progress, and engage with community-contributed study content. WhizPass is a study aid only.

WhizPass is not affiliated with, endorsed by, sponsored by, authorised by, or connected in any way to any certification authority, examination body, or technology vendor, including but not limited to Microsoft Corporation, CompTIA, Cisco Systems Inc., Amazon Web Services Inc., Google LLC, ISC², EC-Council, PMI, ISACA, Oracle Corporation, Palo Alto Networks, or any other organisation. All brand names, product names, certification names, and trademarks referenced on this platform are the property of their respective owners. Their mention on WhizPass is solely for descriptive and identification purposes and does not imply endorsement, affiliation, or partnership.

WhizPass does not offer, claim to offer, or distribute actual, official, or leaked examination questions from any certification body. All content on this platform is intended solely for educational study and practice purposes. WhizPass does not guarantee that any question on this platform has appeared on, will appear on, or reflects the current content of any real certification examination.

3. Disclaimer of Warranties

THE PLATFORM, ALL CONTENT, AND ALL SERVICES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

We expressly disclaim all warranties, including but not limited to:

Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement;
Any warranty that content is accurate, complete, up-to-date, reliable, or fit for any purpose;
Any warranty that the platform will be available, uninterrupted, error-free, or free of viruses or harmful components;
Any warranty that questions or answers reflect real examination content;
Any warranty that use of the platform will result in passing any certification or professional examination;
Any warranty that your data will be preserved indefinitely or against loss.

No statement made by WhizPass — whether verbal, written, or on the platform — shall constitute a warranty of any kind. If any jurisdiction does not allow the exclusion of certain warranties, such exclusions apply to the maximum extent permitted by law in that jurisdiction.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WHIZPASS, ITS OPERATORS, OWNERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND AFFILIATES SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOSS OR DAMAGE WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE PLATFORM.

This limitation applies to all claims under any legal theory, including but not limited to contract, tort, negligence, strict liability, or otherwise, and covers all losses of any nature, including but not limited to:

Failure to pass any certification, professional, or academic examination;
Loss of certification fees, examination registration fees, or any other examination costs;
Loss of employment, income, business opportunity, or professional advancement;
Reliance on any question, answer, explanation, or content on the platform that is inaccurate, incomplete, or misleading;
Decisions made based on content or scores on this platform;
Loss or corruption of data, account information, study progress, or streaks;
Interruption, suspension, or discontinuation of the platform or any feature;
Unauthorised access to your account;
Any indirect, incidental, consequential, special, exemplary, or punitive damages of any kind.

In any jurisdiction where liability cannot be fully excluded, our total aggregate liability to you for all claims arising from your use of the platform shall not exceed the greater of (a) the total amount you paid to WhizPass in the twelve (12) months preceding the claim, or (b) USD $10.00.

5. Content & Intellectual Property

WhizPass does not claim ownership of third-party examination questions, certification content, or vendor materials. All vendor names, certification titles, exam codes, and trademarks belong to their respective owners. WhizPass does not own or claim any ownership of any certification brand referenced on this platform.

Content on WhizPass is sourced from publicly available study materials and community contributions. If you believe any content on this platform infringes your intellectual property rights, please contact us with a detailed notice including identification of the allegedly infringing content and proof of ownership. We will review valid takedown requests in accordance with applicable law.

The WhizPass name, branding, platform design, code, and original content (excluding third-party content) are proprietary. You may not reproduce, distribute, modify, or create derivative works from any proprietary WhizPass content without prior written permission.

User-generated content (notes, comments, flags) remains your responsibility. By submitting content to the platform, you grant WhizPass a non-exclusive, royalty-free, worldwide licence to use, display, and moderate that content for the purpose of operating the platform.

6. User Responsibilities & Conduct

You agree that you will:

Use WhizPass solely for personal, non-commercial study purposes;
Not reproduce, distribute, sell, or share platform content or access with others;
Not attempt to circumvent security, access controls, or authentication mechanisms;
Not use automated tools, bots, or scripts to access or scrape the platform;
Not post content that is defamatory, abusive, harassing, illegal, or infringes third-party rights;
Maintain the confidentiality of your account credentials;
Notify us immediately of any unauthorised access to your account.

You are solely responsible for all activity conducted through your account. WhizPass is not responsible for any losses resulting from unauthorised use of your account.

7. Indemnification

You agree to indemnify, defend, and hold harmless WhizPass and its operators, directors, employees, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal fees) arising from or related to: (a) your use of or reliance on the platform; (b) any content you submit or transmit through the platform; (c) your violation of these Terms; (d) your violation of any applicable law or third-party rights; or (e) any outcomes from examinations you sit after using the platform.

8. Specific Exam Content Disclaimers

WhizPass does not offer real or actual exam questions from any certification vendor. The following additional disclaimers apply:

Microsoft®, Azure®, Windows®, and all associated certification names are registered trademarks of Microsoft Corporation. WhizPass materials do not contain actual Microsoft exam questions.
Cisco® and CCNA®, CCNP®, CCIE® are registered trademarks of Cisco Systems, Inc. WhizPass materials do not contain actual Cisco certification exam questions.
CompTIA® and all associated certification names are trademarks of CompTIA Inc. WhizPass is not affiliated with or endorsed by CompTIA.
Amazon Web Services®, AWS®, and all associated certification names are trademarks of Amazon.com, Inc. WhizPass is not affiliated with AWS.
Google® and all Google Cloud certification names are trademarks of Google LLC. WhizPass is not affiliated with Google.
Oracle® and Java® are registered trademarks of Oracle Corporation. WhizPass materials do not contain actual Oracle exam questions.
Palo Alto Networks® and associated certifications are trademarks of Palo Alto Networks, Inc. WhizPass is not affiliated with Palo Alto Networks.
ISC²® and CISSP® are registered trademarks of ISC². WhizPass is not affiliated with ISC².
All other certification brands and trademarks referenced on WhizPass are the property of their respective owners. WhizPass does not own, claim, or hold any rights over these brands.

9. Platform Availability & Changes

WhizPass does not guarantee continuous, uninterrupted, or error-free access to the platform. We reserve the right, at any time and without notice, to modify, suspend, restrict, or permanently discontinue any feature, page, or the entire platform. WhizPass shall not be liable to you for any such modification, suspension, or discontinuation.

We may, at our sole discretion, suspend or terminate your account at any time without notice for any reason, including violation of these Terms. No refund or compensation will be provided upon account termination.

10. Third-Party Links & Services

The platform may contain links to third-party websites. These links are provided for convenience only. WhizPass has no control over, and accepts no responsibility for, the content, privacy practices, or terms of any third-party websites. Access to any third-party website is entirely at your own risk.

11. Force Majeure

WhizPass shall not be liable for any delay, interruption, or failure in performance of any obligation under these Terms where such delay, interruption, or failure results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, terrorism, government action, cyberattacks, power failures, or failure of telecommunications or internet infrastructure.

12. Severability & Entire Agreement

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and WhizPass with respect to your use of the platform and supersede all prior agreements.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising under or in connection with these Terms shall be resolved through binding arbitration or, where arbitration is not available, in a court of competent jurisdiction. You agree that any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class action.
